The Act became law on 29 April 2026. Its headline measure is a rolling generational ban, which means nobody born on or after 1 January 2009 will ever be legally sold tobacco in the UK. It also tightens the rules on vapes and nicotine products, with an 18+ age of sale and limits on how they are advertised. Here is what it does and when each part starts.
The generational tobacco ban
The part that made the headlines is the generational ban. From 1 January 2027 it becomes illegal to sell any tobacco product to anyone born on or after 1 January 2009. The age of sale then rises by one year, every year. Someone who is 17 now will never reach the age where they can legally buy tobacco, because the threshold keeps moving ahead of them.
It covers tobacco in every form, including cigarettes, hand-rolling tobacco, cigarette papers and heated tobacco. It does not cover vapes or nicotine products. The generational ban is aimed at tobacco alone.
What changes for vapes and nicotine
The Act treats vapes and nicotine products separately. They stay legal for adults, but the rules around them get tighter.
From 29 October 2026, a minimum age of sale of 18 applies to all nicotine products, including pouches, and to nicotine-free vapes. Until now, pouches had no legal age limit of their own, so this closes that gap. The same date brings a ban on buying these products on behalf of under-18s, and removes them from vending machines and free giveaways.
The Act also gives the government powers to ban the advertising and sponsorship of vapes and nicotine products, and to set rules on their packaging, flavours and in-store display. These come into force on dates the government sets through regulations, so they will land over the months that follow rather than all at once. A retail licensing scheme for shops selling tobacco and nicotine products is planned for later.
Why tobacco and nicotine are treated differently
The Act phases tobacco out for a whole generation while keeping vapes and nicotine products available to adults under tighter rules. Tobacco is the target, while nicotine products are being regulated rather than removed.
